1. Agreement to Terms
By accessing or using MikoAdviser ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
2. Description of Service
MikoAdviser is a software-as-a-service (SaaS) platform that helps IT consultants analyze customer requirements and recommend appropriate Microsoft 365 licenses. The Service includes:
- Assessment wizard for gathering customer requirements
- License recommendation engine
- Customer management tools
- Report generation
- Notification services
3. User Accounts
To use the Service, you must create an account. You are responsible for:
- Maintaining the security of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Subscription and Payment
The Service is offered on a subscription basis. By subscribing, you agree to:
- Pay the applicable fees for your chosen plan
- Automatic renewal unless cancelled before the renewal date
- Provide accurate billing information
Refunds are handled on a case-by-case basis. Contact support for refund requests.
5. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose
- Attempt to gain unauthorized access to the Service
- Interfere with or disrupt the Service
- Share your account with unauthorized users
- Reverse engineer or attempt to extract source code
- Use the Service to compete with us
6. Intellectual Property
The Service and its original content, features, and functionality are owned by MikoAdviser and are protected by international copyright, trademark, and other intellectual property laws.
You retain ownership of any data you input into the Service. By using the Service, you grant us a license to process your data solely for providing the Service.
7. Third-Party Services
The Service may integrate with or reference third-party services and content. We are not responsible for third-party services and do not endorse them. Microsoft 365 and related product names are trademarks of Microsoft Corporation.
8. Pricing, Markup & Tax
The Service displays Microsoft 365 license pricing sourced from publicly available Microsoft data. Consulting organizations using the Service may apply their own markup percentage to these prices before presenting them to their customers.
- Markup is set by the consulting organization, not by MikoAdviser. The platform is not responsible for the final prices presented to end customers.
- Tax and VAT estimates displayed in the Service are approximate calculations based on the country and tax rate configured by the consulting organization. These estimates are provided for convenience only and do not constitute tax advice.
- Each consulting organization is solely responsible for ensuring their pricing, tax calculations, and invoicing comply with applicable local laws and regulations.
- Base prices from Microsoft may change without notice. The Service syncs prices periodically but does not guarantee real-time accuracy.
9. Data Processing & Privacy
The Service processes personal data in accordance with our Privacy Policy and applicable data protection laws, including the EU General Data Protection Regulation (GDPR).
- Customer data entered into the Service is processed solely for the purpose of providing license recommendations and related services.
- Data is stored on secure infrastructure within the European Economic Area (EEA) or in jurisdictions with adequate data protection as recognized by the European Commission.
- Organizations may request deletion of their data at any time. Deleted data is retained for a limited period for recovery purposes before permanent purging in accordance with our data retention policy.
- We do not sell, share, or otherwise distribute customer data to third parties except as required to operate the Service (e.g., payment processing via Stripe).
10. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind. We do not guarantee that:
- The Service will be uninterrupted or error-free
- Recommendations will be 100% accurate for every situation
- The Service will meet all your requirements
- Pricing data will be current or accurate at all times
- Tax calculations will meet your jurisdiction's requirements
License recommendations and pricing are advisory only. You should always verify recommendations and prices against current Microsoft documentation and consult qualified tax advisors before making purchasing decisions.
11. Limitation of Liability
To the maximum extent permitted by law, MikoAdviser shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Norway, without regard to its conflict of law provisions.
